Terms of Service

1. Acceptance of Terms
By creating an account or using Freetalk ("the Service"), you agree to these Terms of Service and our Community Guidelines. If you do not agree, you may not use the Service.
2. Eligibility
You must be at least 13 years of age to use Freetalk. Some features — including purchasing coins, sending gifts, shopping, and advertising — are intended for users 18 years or older. By using the Service you represent that you meet these requirements.
3. Your Account
You are responsible for maintaining the security of your account and for all activity that occurs under it. You must not share your credentials or allow others to access your account.
4. Content You Post
You retain ownership of content you upload. By posting content on Freetalk, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, and distribute that content as part of operating the Service. You are solely responsible for the content you post and must have the rights to share it.
5. User-Generated Content & Zero Tolerance
Freetalk hosts user-generated content. You must follow our Community Guidelines, which prohibit objectionable content including sexual or pornographic material, child endangerment, violence, hate speech, harassment, illegal goods, spam, fraud, impersonation, and intellectual-property infringement. We have zero tolerance for objectionable content and abusive users. Content and users can be reported and blocked from within the app, and we remove violating content and remove or ban offending users, typically within 24 hours of a report.
6. Prohibited Conduct
You agree not to: post objectionable content as described in our Community Guidelines; impersonate others; use the Service to distribute spam or malware; attempt to gain unauthorised access to any part of the Service; manipulate engagement, coins, gifts, or earnings; or engage in any conduct that disrupts or harms the Service or its users.
7. Virtual Items, Coins & Gifts
Freetalk offers "coins", a virtual currency you can buy, and "gifts" you can send to creators. On mobile, coins are purchased through the app store's billing system (Google Play or Apple). You acknowledge that:
- Coins and gifts are a limited, non-transferable, revocable licence to a digital good — you do not own them and they have no monetary value outside the Service.
- Coins can only be used within Freetalk and cannot be exchanged for cash by the purchaser.
- Purchases are final and non-refundable except where required by law or the applicable app store's policies.
- Prices are shown before purchase and match the amount charged by the app store. We may change prices or the gift catalogue at any time.
- We may suspend, revoke, or forfeit coins or gifts obtained through fraud, abuse, or violation of these Terms.
8. Creator Earnings & Withdrawals
When a creator receives a gift, they earn "Stars" representing a share of the gift's value. Stars can be redeemed for a payout once the minimum withdrawal threshold is met, subject to verification, applicable fees, taxes, and our review for fraud and policy compliance. We may withhold or reverse earnings linked to fraudulent, abusive, or policy-violating activity. You are responsible for any taxes on amounts you receive.
9. Intellectual Property
Do not post content that infringes others' copyrights, trademarks, or other rights. If you believe content on Freetalk infringes your rights, contact us at legal@freetalk.social and we will respond to valid notices, including by removing infringing content and terminating repeat infringers.
10. Account Deletion & Termination
You may delete your account at any time from Settings & privacy → Delete account in the app, or at freetalk.social/account/delete. We reserve the right to suspend or terminate accounts that violate these Terms or our Community Guidelines, at our discretion.
11. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation.
12. Limitation of Liability
To the maximum extent permitted by law, Freetalk shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
